1.1 These Master Terms and Conditions (“Master T&Cs”) govern all promotional giveaways, prize draws, sweepstakes, contests, and similar campaigns (each a “Campaign”) organised by Smart Horse Technologies B.V. (“Equestic”), including its authorised Campaign Agents.
1.2 Each Campaign has its own specific conditions — including the prize, eligible territories, entry method, and timeline — which are published on the relevant Campaign Page. In the event of any conflict between these Master T&Cs and the Campaign Page, the Campaign Page prevails.
1.3 By entering any Campaign, each Participant confirms they have read, understood, and agree to be bound by these Master T&Cs, the conditions on the Campaign Page, and the Equestic Privacy Policy (www.equestic.com/privacy-policy/).
“Campaign” means a specific promotional giveaway, prize draw, contest, or similar promotion organised by Equestic.
“Campaign Page” means the web page on which a specific Campaign is described and through which entries are accepted.
“Entry Period” means the start and end dates and times (The Netherlands continental time zone) during which entries are accepted, as published on the Campaign Page.
“Participant” means any individual who submits a valid entry to a Campaign.
“Prize” means the reward described on the Campaign Page.
“Winner” means the Participant selected as the recipient of the Prize in accordance with these Master T&Cs and the Campaign Page.
3.1 These Master T&Cs apply to the following Campaign types. The applicable type is stated on the Campaign Page:
4.1 The sponsor of all Campaigns is Smart Horse Technologies B.V. (Rondveld 21, 5845 EP, Sint Anthonis, The Netherlands), trading as Equestic (the “Sponsor”).
4.2 Equestic may appoint authorised third-party agencies or moderators (“Campaign Agents”) to assist in operating a Campaign, including entry collection, draw administration, winner verification, and prize fulfilment. Campaign Agents act on behalf of Equestic under appropriate data processing agreements. The involvement of a Campaign Agent does not alter the Sponsor’s responsibilities to Participants; Equestic remains the data controller and legal Sponsor. Where a Campaign Agent processes personal data, this is disclosed on the Campaign Page.
4.3 All Participant queries may be directed to Equestic at service@equestic.com, regardless of which Campaign Agent is involved.
5.1 For free-entry Campaigns (including Survey-Linked Prize Draws): no purchase, payment, or financial contribution of any kind is required to enter or win.
5.2 Where entry requires completing a survey or questionnaire, Equestic’s position is that such participation does not constitute legally cognisable consideration for the purposes of lottery, sweepstakes, or gambling law in any applicable jurisdiction, because: (a) no financial cost is imposed on the Participant; (b) participation is entirely voluntary; (c) the time and effort involved is de minimis; and (d) information provided is collected for research purposes only and confers no direct economic benefit on the Participant.
5.3 By entering a Survey-Linked Prize Draw, each Participant expressly acknowledges that completing the survey is not the provision of legally material consideration and that the Campaign is a free prize draw.
5.4 Completing a survey will not increase a Participant’s statistical odds of winning unless the Campaign is a Skill-Based Contest.
5.5 For Purchase-Linked Promotions: a qualifying purchase is a condition of entry. Any free-entry route available for a specific Campaign will be described on the Campaign Page.
Campaigns are open worldwide by default, subject to the restrictions set out below. Equestic may further restrict eligible territories for a specific Campaign by stating so on the Campaign Page. Absent any such restriction, these default rules apply.
6.3 Equestic reserves the right to exclude any additional countries or territories from any specific Campaign, as stated on the Campaign Page.
6.4 Participants are solely responsible for determining whether their participation is permitted under the laws of their country, state, or province of residence. If in doubt, do not enter and contact service@equestic.com for guidance.
7.1 The entry method for each Campaign is described on the Campaign Page.
7.2 Unless the Campaign Page states otherwise, entry is limited to one (1) entry per person per Campaign. Multiple entries using different email addresses, identities, or devices are prohibited and will result in disqualification.
7.3 Automated, scripted, bulk, or fraudulent entries are strictly prohibited and will be disqualified.
7.4 Entries must be submitted during the Entry Period. Late, incomplete, or illegible entries will not be accepted.
7.5 Providing entry information is voluntary. By submitting an entry, a Participant confirms that all information provided is accurate and their own, and agrees to the Equestic Privacy Policy (www.equestic.com/privacy-policy/). A valid email address is required and is the sole channel through which Equestic will contact Participants in connection with the Campaign. No other contact methods will be used or monitored for Campaign purposes.
8.1 The method of winner selection is described on the Campaign Page. Unless the Campaign is a Skill-Based Contest, the Winner is selected by random draw from all valid eligible entries received during the Entry Period, conducted by Equestic or a Campaign Agent using a documented, verifiable random selection process.
8.2 Equestic will attempt to notify the potential Winner by email to the address provided at entry within the timeframe stated on the Campaign Page (or, if not stated, within fourteen (14) calendar days of the draw date). Email is the sole notification channel; Equestic will not contact potential Winners by any other means.
8.3 The potential Winner must respond and confirm acceptance of the Prize within seven (7) calendar days of notification (or such other period stated on the Campaign Page). Failure to respond within the specified period, or failure to satisfy eligibility verification, will result in forfeiture of the Prize. In such cases, Equestic reserves the right, at its sole discretion, either to select an alternative Winner or to withhold the Prize entirely.
8.4 Where required by applicable law (including the Canadian skill-testing question requirement), additional steps must be completed before a potential Winner is confirmed as the final Winner.
8.5 Winner details will only be disclosed to third parties where required by applicable law or expressly requested by the Winner.
9.1 The Prize is described on the Campaign Page, including its approximate retail value.
9.2 The Prize is non-transferable, non-exchangeable, and has no cash alternative, unless Equestic determines otherwise at its sole discretion or is required by applicable law.
9.3 Equestic reserves the right to substitute the Prize for an alternative of equal or greater value if the stated Prize is unavailable for any reason beyond its reasonable control.
9.4 All taxes, customs duties, import charges, and other legal or financial consequences arising from acceptance or use of the Prize are the sole responsibility of the Winner. Winners are strongly advised to seek independent tax and legal advice before accepting the Prize. Once a Winner confirms acceptance of the Prize, the Prize cannot be returned or exchanged.
9.5 Delivery of physical prizes is subject to applicable international trade laws and export controls. Equestic cannot ship prizes to sanctioned territories or to individuals subject to applicable sanctions. If a Winner is determined to reside in, or be subject to sanctions of, an excluded jurisdiction, Equestic reserves the right to withhold the Prize and select an alternative Winner or to retain the Prize.
10.1 Equestic is the data controller for personal data collected in connection with Campaigns. The legal basis for processing is: the performance of the Campaign terms with the Participant (Article 6(1)(b) GDPR) for administering the Campaign, determining winners, and delivering prizes; and Equestic’s legitimate interests (Article 6(1)(f) GDPR) in preventing fraud, ensuring Campaign integrity, and complying with legal obligations.
10.2 Personal data collected during a Campaign may be used for the following purposes: (a) administering the Campaign (eligibility verification, draw administration, Winner notification); (b) prize fulfilment and delivery; (c) fraud prevention and legal compliance; and (d) where expressly consented to, sending marketing communications.
10.3 Equestic will not use Campaign entry data for marketing purposes without a separate, freely given, specific, and informed opt-in. The marketing opt-in is presented as a distinct, optional action. Declining the marketing opt-in does not affect eligibility to enter or win. Consent to marketing may be withdrawn at any time via the unsubscribe link in any marketing email or by contacting service@equestic.com.
10.4 Where Campaigns are administered through third-party platforms or Campaign Agents, such parties may act as data processors, independent controllers, or joint controllers as determined by the nature of their involvement and applicable law. Details of any Campaign Agent processing personal data are disclosed on the Campaign Page.
10.5 Participant data is retained only for as long as necessary for the purposes described in these Terms and as required by applicable law, and normally no longer than ninety (90) days after the conclusion of the Campaign.
10.6 For EU/EEA and UK Participants, Equestic processes personal data in accordance with the EU General Data Protection Regulation (GDPR) (Regulation 2016/679). For Swiss Participants, processing is carried out in accordance with the Swiss Federal Act on Data Protection (FADP). Participants have the rights of access, rectification, erasure, restriction, portability, and objection, and the right to withdraw consent at any time without affecting the lawfulness of prior processing.
10.7 For California residents, additional rights apply under the CCPA as amended by the CPRA. These are set out in the Equestic Privacy Policy.
10.8 Personal data may be transferred outside the EEA, UK, or Switzerland where necessary for Campaign administration (for example, to Campaign Agents or prize fulfilment partners). Such transfers are subject to appropriate safeguards, including Standard Contractual Clauses where required.
10.9 Recipients of Participant data may include: hosting providers, survey platform providers, analytics providers, prize fulfilment partners, and Campaign Agents.
10.10 To exercise any data protection right or to submit a complaint, contact Equestic at service@equestic.com. Participants also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, www.autoriteitpersoonsgegevens.nl), which is Equestic’s lead supervisory authority given its Dutch incorporation, or with the supervisory authority of their country of residence.
10.11 Full details of Equestic’s data handling practices are set out in the Privacy Policy at www.equestic.com/privacy-policy/.
11.1 Where a Campaign is Survey-Linked, survey responses are collected for research and analytical purposes and are kept separate from prize draw entry data.
11.2 Survey responses will, to the extent practicable, be stored and analysed on an anonymised or pseudonymised basis. Individual survey responses will not be used to identify a Winner or affect odds of winning.
12.1 Except where prohibited by applicable law, by accepting a Prize, the Winner grants Equestic a non-exclusive, royalty-free licence to use their first name, initial of surname, and country of residence for publicity purposes related to the Campaign (e.g. announcing the winner on the Equestic website or social media channels). This consent to use winner photography, video content, or testimonials is included in the acceptance of the Prize and these Terms.
12.2 Where publicity use is prohibited by law (e.g. certain US states), Equestic will comply without prejudice to the Winner’s right to receive the Prize.
13.1 Where a Campaign invites Participants to share content or post about the Campaign in exchange for additional entries or other benefits, such posts must include a clear and prominent disclosure that the content is connected to a promotion. Examples of compliant disclosures include #ad, #sponsored, #promotion, or another clear label that communicates the promotional nature of the post to the audience.
13.2 Equestic reserves the right to disqualify Participants who fail to include required disclosures where applicable.
13.3 Equestic complies with the FTC’s Endorsement Guides (16 C.F.R. Part 255) for US-facing Campaigns, with applicable CAP/ASA guidance for UK-facing Campaigns, and with equivalent consumer protection and advertising transparency requirements in other applicable jurisdictions.
14.1 Equestic intends that all paid promotional content related to Campaigns be clearly identifiable as advertising. Equestic will provide platforms with information reasonably required to comply with applicable transparency obligations, including those under the EU Digital Services Act (Regulation (EU) 2022/2065) and equivalent national requirements.
14.2 Campaign entry forms and landing pages are designed not to employ manipulative design or dark patterns that could mislead Participants into sharing more data or accepting marketing they did not intend to agree to.
14.3 Equestic will provide information reasonably required by any platform hosting or distributing a Campaign to facilitate that platform’s compliance with applicable transparency requirements.
15.1 To the maximum extent permitted by applicable law, Equestic and its Campaign Agents shall not be liable for: (a) technical failures, server outages, or disruptions preventing or delaying entry; (b) lost, late, misdirected, corrupted, or incomplete entries; (c) injury, loss, or damage of any kind arising from participation or from acceptance or use of a Prize; (d) inaccuracies in information provided by Participants; or (e) tax or other legal liabilities incurred by Winners in connection with a Prize.
15.2 Nothing in these Master T&Cs excludes or limits Equestic’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by its negligence, or any other liability that cannot be excluded or limited under applicable law.
16.1 Equestic reserves the right, at its sole and absolute discretion, to disqualify any Participant at any time and without obligation to provide reasons, including where it deems such disqualification to be in the interests of the integrity of the Campaign. Without limiting the foregoing, disqualification may occur where a Participant: (a) provides false or misleading information; (b) uses automated or fraudulent entry methods; (c) breaches these Master T&Cs or the conditions on the Campaign Page; (d) acts in a manner that is abusive, offensive, or harmful; or (e) whose participation would cause Equestic to breach applicable law.
16.2 Equestic’s decision on disqualification is final and binding.
17.1 Equestic reserves the right to amend, suspend, or cancel a Campaign at any time if circumstances arise outside its reasonable control, including technical failures, fraud, events affecting Campaign integrity, or a change in applicable law.
17.2 In the event of cancellation, no prize will be awarded unless Equestic elects otherwise at its sole discretion.
18.1 These Master T&Cs are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law provisions.
18.2 Any dispute shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, except that: (a) Participants who are consumers in an EU Member State may bring proceedings before the courts of their country of habitual residence in accordance with applicable mandatory consumer protection law; and (b) nothing in this clause restricts the rights of consumers under the mandatory consumer protection laws of their country of residence.
19.1 Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in full force and effect.
19.2 Entire Agreement: These Master T&Cs, together with the Campaign Page conditions and the Equestic Privacy Policy, constitute the entire agreement between Equestic and each Participant for the Campaign.
19.3 No Waiver: Failure by Equestic to enforce any provision does not constitute a waiver of its right to do so.
19.4 Language: These Master T&Cs are in English. If a translation is provided, the English version prevails in the event of inconsistency.
19.5 Versioning: Equestic may update these Master T&Cs. Each Campaign is governed by the version in effect at the Campaign launch date.
